PREAMBLE

These General Terms and Conditions of Sale (hereinafter "GTCS") are concluded exclusively between (1) the company TARA JARMON SAS, registered with the Paris RCS  under the number 408 140 671 whose head office is located at 8bis rue Dieu, exclusive owner of the operating license for the website of the Tara Jarmon brand (hereinafter referred to as Tara Jarmon) and (2) any person making a purchase on the site https://tarajarmon.us (hereinafter referred to as the " Customer”). The Customer hereby expressly declares that he or she is an individual, natural person, non-professional or merchant, that he or she is of legal age or has parental authorisation and that he or she has full and entire legal capacity to contract and perform an online order on the website tarajarmon.us (hereafter, Tara Jarmon). The Customer and Tara Jarmon agree together that their relations are governed exclusively by these General Terms and Conditions of Sale. In this regard, the Customer acknowledges that any order validated by a "double click" implies irrevocable acceptance of these General Terms and Conditions of Sale. This validation of the Customer, associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages, constitutes the unequivocal will of the Parties thus deemed to be signatories of the distance selling act in question.

Tara Jarmon reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. Each order will be deemed to have been placed according to the terms of the GTCS in force on the day it is placed on the website tarajarmon.us , the date of posting of the GTCSs on the website being the date of entry into force.For any question relating to an online purchase, the Customer can contact Tara Jarmon Customer Service;

PROFESSIONAL EQUALITY INDEX

In accordance with legal obligations, we bring your attention to our global  professional equality index between men and women for the 3 entities of the Tara Jarmon group: TARA JARMON, TJ PASSY & TJ OUTLET.
To put an end to the gender pay gap, Muriel Pénicaud, the French Minister of Labour, and Marlène Schiappa, the French Secretary of State for Equality between Women and Men and the Fight against Discrimination, announced in November 2018 the creation of an equality index between men and women. Using the 5 indicators determined by the French Government, we have calculated our score on a total of 100 points.
All entities combined, our group obtains a result of 35/100, which is partly explained by the large number of women within our group.

ARTICLE 1. VALIDATION OF THE ORDER ON THE Tara Jarmon WEBSITE

To place an order on the Tara Jarmon site, the Customer will be guided through the following steps:
- Selection of products on the site placed in the "Basket",
 - Choice, when offered, of the delivery method for the products displayed in the "Basket",
 - Presentation of the summary of the order, modifiable, and its total price,
 - Choice of payment method,
 - Sending of an order validation email to the Customer confirming their registration after acceptance of payment.

The order validation email sent to the Customer confirms Tara Jarmon's acceptance of the Customer's order, and confirms the formation of the sales contract between the Parties.

ARTICLE 2. VALIDITY OF OFFERS - AVAILABILITY OF PRODUCTS

The products displayed on the Tara Jarmon website at a given time are in principle deemed to be available in stock at that same time, except for a time-limited offer in the context of a particular operation expressly mentioned as such on the product page.This a priori availability is checked after the order has been accepted for payment and is confirmed by the shipping email sent by Tara Jarmon. In the event of unavailability of one or more products, Tara Jarmon undertakes either to offer the Customer a new delivery date for the product (s) ordered or to reimburse them by crediting the payment method used during the purchase, and this within 14 calendar days of payment of the order. If a technical event prevents the crediting of the means of payment used, Tara Jarmon will offer the Customer a bank cheque payable to him or her and send it by post to the billing address provided.The product and price offers are deemed to be those displayed during the checkout process shown on the "BASKET" page of the Tara Jarmon website. Thus, only the price indicated on this page, corresponding to that invoiced to the Customer during the checkout process for his or her order is valid and commits Tara Jarmon from a contractual point of view. Therefore, any typographical error on any other page likely to occur on graphic and / or promotional elements within the website, can not engage the responsibility of Tara Jarmon.

ARTICLE 3. PRICE

The prices displayed on the Tara Jarmon site are expressed in euros (€), US dollars ($), pound sterling (£) and Swiss franc (CHF), depending on the version of the site selected, and are understood to be all public prices with charges included as they may be applicable in mainland France on the date of consultation of said offers. The VAT applied is that in force on the date the order is placed. Specific taxes, apart from VAT, applicable according to regulations (such as for example the furniture eco-tax or the participation eco-tax), are only indicated on the Basket page, the only page to be valid as indicated in the last paragraph of Article 2 above.

All product prices are displayed on the Tara Jarmon website and exclude shipping costs or any other ancillary service. They only include the price of the product itself, as described, as well as its packaging.

Tara Jarmon reserves the right to modify its prices at any time but undertakes to apply the prices displayed when the order is placed, subject to availability on that date.

The products remain the property of Tara Jarmon until full payment is received by the Customer.

ARTICLE 4. PAYMENT

4.1 TERMS OF PAYMENT

 

Whatever the method of payment chosen among those accepted on our site, orders will only be deemed to have been recorded after validation or receipt of payment.Thus, as long as the payment is not validated by the intermediary chosen by the Customer, the order cannot be prepared by Tara Jarmon's services.
 

4.1.1 Payment by Bank Card


Payment can be made using the following bank cards:  French Carte Bleue, VISA, MASTERCARD, MAESTRO and AMERICAN EXPRESS. The Customer is free to consult the General Terms and Conditions of Sale and Use of each of these bank cards on the websites of our Partners.
The choice of one of these payment cards implies tacit acceptance of the general terms and conditions of sale and use of said Partners.
We invite our customers to refer to it, as Tara Jarmon cannot be held responsible for the conditions thus set by these independent Partners.Online payment by bank card is perfectly secure and allows you to enter the number, expiry date and security code of the card with confidence in the fields provided for this purpose. Indeed, bank card details are encrypted using SSL (Secure Socket Layer) and never pass unencrypted over the network. Payment is made directly through the bank. Tara Jarmon has no access to these details and cannot store them on its servers. This is the reason why they are requested for each new transaction on our website.
 

4.1.2 Payment by Paypal


Paypal payments are accepted on the Tara Jarmon  site and are then made through the Partner in question and according to its own general terms and conditions of sale and use of its services.The choice of this payment implies tacit acceptance of the general terms and conditions of sale and use of the Partner.
We recommend our customers to refer to it, as Tara Jarmon  cannot be held responsible for the conditions set by these independent Partners.

4.2 FIGHT AGAINST FRAUD


Tara Jarmon reserves the right to check the validity of the payment, before shipping the order, by any means it deems necessary (including identity, proof of address, etc.).
 

4.3 PAYMENT INCIDENT

 
Tara Jarmon reserves the right to refuse to make a delivery or to honour an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. In the event of fraud, Tara Jarmon  reserves the right to remove any member without notice or compensation.

ARTICLE 5. DELIVERY

5.1 ORDER PREPARATION TIMES


Tara Jarmon  reserves the right to subcontract all or part of the preparation and shipment of the order to a third party appointed for the execution of this service. Since all products sold by Tara Jarmon are deemed to be in stock, orders are prepared within 5 working days from the first working day following the registration of the order within the meaning of these GTCS. Thus, orders registered on a Saturday, Sunday or public holiday will be processed on the next working day.

All of the deadlines mentioned on the Tara Jarmon website are understood to be clear deadlines.The ordered product is delivered to the address appearing on the order form and recorded as the "delivery" address.
In the event of an entry error, in particular an incorrect or incomplete delivery address, Tara Jarmon cannot be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of products following an entry error by the Customer will be the sole responsibility of the latter.
 

5.2 ORDER DELIVERY TIMES


Tara Jarmon  reserves the right to choose the most suitable mode of transport depending on the nature of the product, its weight and its volume, which the Customer declares to have read and accepted.
 
Delivery times may not exceed 30 working days after the date of validation of the payment by the Customer (date of registration of the order).
Delivery times cannot be guaranteed in the event of force majeure, as defined by French law and jurisprudence. Delivery times do not take into account any Customer payment control procedures that would delay the shipment of his or her order (see provisions of Article 4.2). The announced deadlines shall run from the date of registration of the order. The expected delivery date is indicated when ordering and on each of our product sheets. This time is an average time corresponding to the service used for delivery in Mainland France. In case of absence, the Customer will be responsible for recovering the product from the services concerned.
 

5.3 DELIVERY TRACKING


The Customer can track his or her order at any time using the order number communicated to him or her in the email formally registering his or her order, in his or her "My Account" section on the Tara Jarmon website.This section allows a precise follow-up for each mode of transport envisaged, of the order and its status, relating in particular to its expedition or its delivery.

It is recalled that as all communication between the Customer and the Tara Jarmon website being mainly carried out through email exchanges, it is essential that the Customer send Tara Jarmon a valid and regularly updated email address. If not, Tara Jarmon cannot be held responsible for the consequences resulting from the communication of an incorrect or not updated email address.
 

5.4 DELIVERY ZONES


Delivery takes place in Mainland France, Belgium, Spain, Luxembourg, Italy, Ireland, Finland, Denmark, Portugal, Deutschland, Cyprus, Germany, Austria, Andorra, Bulgaria, Estonia, Greece, Hungary, Latvia, Liechtenstein, Slovakia, Slovenia, Sweden, City State of Vatican, Croatia, Czech Republic, United Kingdom, Switzerland and United States.
 
The Items are exclusively delivered to the delivery address indicated by the Customer when ordering. No modification of the delivery address can be made after the order has been confirmed by Tara Jarmon.
 

5.5 SPECIAL DELIVERY MODALITIES


The delivery methods for Tara Jarmon products are established by Tara Jarmon and depend on their postal volumetric.

When a product's postal volumetric has been calculated, the Customer will be free to choose between collection from a French Point de Retrait (Collection Point), or delivery to his or her home/chosen address or to a store.

At the end of the validation of these transport modalities and before the payment of the order, the Tara Jarmon  site will display a summary of the order by mode of transport, to which the products in question are eligible and according to the chosen option by the Client when these were offered to him or her. The cost of the transport modalities affected or chosen will then be displayed before payment of the order.

When the order has been duly prepared and is ready for shipment, the Customer will receive an email relating to the dispatch of each part of his or her order by means of transport thus agreed.

 ⇒  Delivery to a Collection Point:

Tara Jarmon offers the Customer who has chosen the Collection Point option, the names and addresses of the professionals offering these services closest to the chosen delivery location. The Customer can then consult the opening hours and days of the chosen Collection Point.
Upon receipt of the order at the Collection Point, the Customer has 14 calendar days to collect their package(s). Failing that, the order will be sent back to Tara Jarmon who will follow up with the Customer via email in order to resend the order at the Customer's expense. If the Customer does not reply within 7 days of the send date of this reminder email, Tara Jarmon  will consider that the Customer has exercised his or her right of return and will proceed with a refund under the conditions provided for in the exercise of the right of retraction (see Article 6 -1 of these GTCS).
 
⇒  Delivery by Colissimo:

Delivery by Colissimo is a service offered by the French Post Office that has its own General Terms and Conditions of Use. In the event of absence or inability to drop off the package with a third party, the Customer will receive a deliveration notification. He or she will then have 14 calendar days to collect his or her package(s) from the post office indicated on the said delivery notification. Failing that, the order will be sent back to Tara Jarmon who will follow up with the Customer via email in order to resend the order at the Customer's expense. If the Customer does not reply within 7 days of the send date of this reminder email, Tara Jarmon  will consider that the Customer has exercised his or her right of return and will proceed with a refund under the conditions provided for in the exercise of the right of retraction (see Article 6 -1 of these GTCS).
 
  In-store delivery:

Tara Jarmon offers the Customer the possibility of choosing free delivery to a store (excluding department stores).
This delivery method is only possible in eligible stores (limited list displayed when choosing the delivery method when placing the order).
The Customer is informed by email of the availability of his or her order in the selected store.
He or she then has 15 calendar days from receipt of his or her order to go to the store and collect his or her order.
To collect their order, the Customer must go to the store and provide proof of identity as well as the email confirming their order or informing them that their order is available for collection.
Beyond 15 calendar days, the order will be automatically returned to the Tara Jarmon depot and will be cancelled.
In the event of cancellation, reimbursement of the price paid for the order will be made within 15 calendar days.
The Customer fully and exclusively assumes the risk of loss or damage to the items after their collection from the store.
 

5.6 DELIVERY RATES


Transport invoicing follows a calculation rule that takes into account the destination alongside the weight of the package.The prices indicated are all in euros (€) all taxes and charges included, including the rate of VAT at the rate in force on the day of delivery. The delivery rate amount is automatically calculated as soon as a product is added to the Basket and is based on delivery in mainland France. The Customer can freely consult the invoicing and the carrier associated with the delivery of his or her products.

The final calculation of the shipping costs for other destinations is carried out once the postal code has been entered on the delivery address form and before the Customer confirms his or her order.

The specific offers for free shipping are only valid for shipment to mainland France, unless expressly stated otherwise.

ARTICLE 6. RIGHT OF RETRACTION

6.1. CONDITIONS FOR EXERCISING THE RIGHT OF RETRACTION


  ⇒  Deadline

In accordance with the provisions of Article L. 121-21 of the French Consumer Code, the Customer has a period of 14 calendar days to exercise his or her right of retraction, without having to  justify any reason. The deadline starts the day after the day of receipt of the order.
In the case of an order for several goods delivered separately or in the case of an order for goods made up of lots or multiple parts whose delivery is spread over a defined period, the period starts from receipt of the last item or lot or of the last part delivered.
For contracts regarding the regular delivery of goods during a defined period, the period runs from the receipt of the first item.
 
⇒  Exercise of the right of retraction

To exercise his or her right of retraction, the Customer must inform Tara Jarmon of his or her decision by sending the Company, before the expiration of the aforementioned 14-day period, the standard retraction form provided for this purpose, which will have been sent to him or her with the email confirming his or her order (and reproduced as an appendix to these GTCS), or any other unambiguous declaration expressing his or her will to retract.  
 
⇒  Loss of the right of retraction

Pursuant to Article L 121-21-8 of the French Consumer Code, it is recalled that the right of retraction cannot be used for contracts:
1° For the provision of services fully executed before the end of the retraction period and the execution of which has begun after the express prior consent of the consumer and express waiver of his or her right of retraction;


2° The supply of goods or services, the price of which depends on fluctuations in the financial markets beyond the control of the professional and likely to occur during the retraction period;


3° The supply of goods made to the consumer's specifications or clearly personalised;


4° The supply of goods liable to deteriorate or expire rapidly;


5° The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;


6° The supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items;


7° The supply of alcoholic beverages the delivery of which is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations on the market beyond the control of the professional;


8° Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him or her, within the limit of spare parts and work strictly necessary to respond to the emergency;


9° Supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;


10° Supply of a newspaper, periodical or magazine, except for subscription contracts to these publications;


11° Concluded at a public auction;


12° The provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or period;


13° The supply of digital content not supplied on a physical medium, the execution of which has begun after the express prior consent of the consumer and express waiver of his or her right of retraction.
 
⇒  Conditions relating to the condition of the product

For the exercise of this right of retraction, the returned product must be returned in a condition allowing its immediate resale. The product must therefore be returned in  new condition, along with all the various manuals and accessories with which it was delivered and in its original packaging. Tara Jarmon reserves the right to refuse reimbursement of the product if all of these conditions are not met.
 
⇒  Terms of reimbursement

In the event of exercise of the right of retraction within the aforementioned period, and in accordance with the provisions of Article L121-21-4 of the French Consumer Code, Tara Jarmon will reimburse the Customer for the price of the product(s) returned as such as well as the shipping costs of the product(s) in question within a period of 14 calendar days from the date on which it was informed of the Customer's decision to retract.
Tara Jarmon nevertheless reserves the right to defer reimbursement until recovery of the goods or until the Customer has provided proof of shipment of these goods, the date chosen being the date of the first of these two conditions.Reimbursement will always be made on the basis of the sums actually paid by the Customer, as entered on his or her invoice. However, Tara Jarmon reserves the right to refuse to reimburse the additional delivery costs generated by a more expensive delivery method expressly chosen by the Customer when Tara Jarmon  had offered the Customer a standard delivery method.The transport costs to be reimbursed will be determined as if the Customer had never purchased the returned product (s).
Finally, in principle and unless otherwise expressly requested by the Customer, Tara Jarmon will reimburse the latter by crediting the means of payment used during the payment. In case of material impossibility to use this process, Tara Jarmon will offer the Customer a cheque payable to him or her for the amount due and to send it to him or her by post.  
 
⇒   Return shipping costs

Return shipping costs are expressly borne by the Customer, who recognises and accepts them by adhering to these General Terms and Conditions of Sale.

ARTICLE 7. COMPLAINTS REGARDING THE ORDER

If during the unpacking of his or her products and within 15 calendar days from receipt of the products, the Customer discovers that a product does not comply with his or her order or the product sheet (example: error on the product, the model, colour, other) Tara Jarmon  will undertake to replace it or to reimburse the Customer for all of its costs as soon as the defect is noted and confirmed. To do this, the Customer must contact Tara Jarmon Customer Service to make a complaint and follow the given procedure. After receipt of the duly returned product and observation of the non-conformity or damage reported by the Customer, Tara Jarmon may at its sole discretion,
 - Either send a new product to the Customer, at no additional cost,
 - Or refund the sums paid during the purchase of this product.
Any other potential defect during the "life" of the product will be assessed by the after-sales service.

ARTICLE 8. AFTER-SALES SERVICE

Apart from the commercial or legal guarantee, the Customer always has the possibility of contacting the Tara Jarmon  Customer Service team to answer his or her questions relating to the use of a product, its maintenance methods or the order of a part that has become defective.

ARTICLE 9. INTELLECTUAL PROPERTY

All elements of the Tara Jarmon site, whether visual or sound, including the brand, logo, texts, photos, videos and domain name, are protected by copyright, trademark law or patents. The Publisher of the Tara Jarmon site holds an exclusive license and operating contract granted by their owner. As such and in accordance with the French Code of Intellectual Property, only private use is authorised, subject to different or more restrictive provisions of intellectual property legislation. Any total or partial reproduction of the Tara Jarmon site or of any of its audio, visual or text content is strictly prohibited without express prior written consent.

ARTICLE 10. LIABILITY

For all stages of access to the site, the ordering process, delivery, Customer service or subsequent services, Tara Jarmon is only bound by an obligation of means. Tara Jarmon shall not be held liable for any inconveniences or damage arising from the use of the Internet, including connection interruptions, external intrusions or the presence of computer viruses, or any force majeure, in accordance with French jurisprudence. In addition, Tara Jarmon cannot be held responsible in the event that the order is not completed or if it was prevented from complying with any of its obligations in the case of force majeure within the meaning of French jursiprudence, and in particular in the event of bad weather preventing the delivery of the order.

ARTICLE 11. INTEGRALITY

If a change of legislation, of regulations or a juridical decision cancels one of the clauses of the current agreement, it would in no case affect the validity and the respect of the general current General Terms and Conditions of Sale.
 

ARTICLE 12. DURATION

These GTCS apply throughout the duration of the online services and products offered by Tara Jarmon.

ARTICLE 13. PROOF

The computer records, stored in the computer systems of the company Tara Jarmon and its partners under reasonable security conditions, will be considered proof of communication, orders and payments between the parties.

ARTICLE 14. STORAGE AND ARCHIVING OF TRANSACTIONS

The archiving of orders and invoices is done on reliable and long-lasting supports in order to keep an exploitable copy complying with Article 1348 of the French Civil Code.

ARTICLE 15. DISPUTES

These terms and conditions are subject to French law. In the event of a dispute, Tara Jarmon and the Client will attempt to resolve it amicably, within the framework of either a conventional mediation procedure or any other alternative dispute resolution method. In the event of failure of the procedure, only the French courts will be competent.

ARTICLE 16. TARA JARMON CUSTOMER SERVICE

For any information or question, Tara Jarmon's Customer Service is available to the Customer:
- By electronic means via the contact form, after having connected to the "My Account" space.
For any subsequent electronic correspondence, and in order to facilitate and accelerate the processing of requests, the email address used for the Customer account should be used.

ARTICLE 17. INFORMATION TECHNOLOGY AND LIBERTIES

17.1 PERSONAL DATA PROTECTION POLICY


The personal and confidential data that you provide when using the service is strictly necessary for the processing of your account, the use of the service, the needs of technical support, the proper functioning, the improvement of the service and the options in accordance with these Conditions, and to manage the sending of the Newsletter by Tara Jarmon to users who have given their consent. In addition, Tara Jarmon may undertake studies and statistical analyses on the use and type of users of the service.

These nominative data are intended for the company Tara Jarmon. Personal data cannot be transferred or rented to third parties without your express prior consent. They are kept within the European Union throughout your contractual relationship with Tara Jarmon, then archived in the event of a legal or regulatory obligation.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the Data Protection Act and Freedoms of January 6, 1978, you have a right of access, modification, complaint, deletion, portability, opposition and limitation of processing on all of your personal data. You also have the right to define the guidelines relating to the retention, deletion and communication of your data after your death.

The Tara Jarmon Company reserves the right to monitor the use of the Site by the visitor by using the website analysis service called Google Analytics provided by the Google Inc. Company. The Google Analytics system uses cookies (see paragraph above).

The data generated by these cookies about your use of the website (including your IP address) will be transmitted to and stored by Google on servers located in the United States.
